1 - OBJECT

These General Terms of Sale govern the sale of products, presented on the web site, www.laceremoniedespetits.com , by a France-registered business (LaCeremonieDesPetits represented by DAVID GEROLAMI) to a physical, non-business person (the customer).

LaCeremonieDesPetits reserves the right to modify or to adapt at any time these present General Terms of Sale. In case of modification, will be applied to every order the General Terms of current Sale in the day of the validation of the order. The last date of revision of the general terms of sale is indicated at the top of this page.

As such, by placing an order through the above-mentioned web site, the customer implicitly accepts and agree these General Terms of Sale, which constitute a legally binding agreement. Orders may only be placed for products which are currently in stock.

So it is asked to every customer, before validating his order, to agree with the compartment acceptance of the Terms of Sale which will be only applicable to the contract so concluded.

2 - PRODUCTS

Articles presented on the www.laceremoniedespetits.com site are described with the biggest loyalty. In spite of all the made precautions, if an error occurred, LaCeremonieDesPetits could be considered on no account responsible and engaged by this fact.

Photos of products shall not be contractually binding. Under no circumstances may LaCeremonieDesPetits be held liable for any errors which may occur in the content of the web site, www.laceremoniedespetits.com.

LaCeremonieDesPetits cannot be considered as responsible of the difference of tint or the depiction of the products which would seem different further to their transcription on the site.

We make a commitment to verify the availability of products at the time of your order.

In case of order by fax or by mail, LaCeremonieDesPetits cannot be considered as responsible of the unavailability of a product which will before have been seen on the site.

If an article is not in stock and is for a moment unavailable, we make a commitment to inform you about its availability within 5 in 6 weeks or to propose you a similar article.

If after validation of your order, a product came to be unavailable for reasons independent from the will of LaCeremonieDesPetits (case of absolute necessity, shortage of stock of ordered tissues, burdens of our suppliers) we make a commitment to return towards you in order to propose you, the replacement by a similar article, or the refund of the sums possibly advanced if you wish to cancel your order.

LaCeremonieDesPetits does not insure the alterations of articles presented and sold on the website: www.laceremoniedespetits.com.

3 - PRICES

Our prices are indicated in EURO (VAT (Value Added Tax) not applicable, article 293 B of the French general code of the taxes). Prices are guaranteed subject to error of typography or printing.

Should the VAT rate change, the prices of the products may be modified.

All prices are exclusive of any shipping and customs costs (for deliveries outside the European Union), which costs shall be borne by the customer. If the customer refuses to pay the customs taxes, the parcel will be destroyed and we could not refund the order.

LaCeremonieDesPetits reserves the right to modify its prices at any time, but makes a commitment to apply the price rate which will have been indicated the day of the validation of your order.

The payment of your order is only made in EURO.

The property of the sold products remains acquired to LaCeremonieDesPetits up to complete payment of the price.

4 - ORDERS

Orders can only be made on our website www.laceremoniedespetits.com. A guided search will allow you to find easily all our articles and to choose.

The order will be validated only when the payment of the totality of the price of the order (products + shipping costs) will be realized and registered on our bank account.

Any order not accompanied with a payment or with a partial payment cannot be honored.

The order will be valid only during 7 days. Beyond this deadline, without reception of your payment, your order will be void.

5 - PAYMENTS

1/ By check (only from French bank) :

After having booked your order, you will have to indicate that you will settle the totality of your order by check.

Your check will have to correspond to the total amount of your order increased by the shipping costs and denominated in the order of: LaCeremonieDesPetits.

It will be advisable to print your order form and to send it back accompanied with your check by mail at the following address:

2/ By bank transfer :

After having booked your order, you will have to indicate that you will settle the totality of your order by bank transfer. You will then be redirected towards a page containing our banking address and account number allowing you to realize your transfer with your bank. If the information was missing, we invite you to get in touch with us for a possible further information.

The possible charges of transfer are at your charge.

It is important that the title of your transfer is the same name as that registers on your order form.

In case of payment by bank transfer, the order will be validated definitively only after recording of your transfer on our bank account.

3/ By PayPal :

PayPal is a complete platform of payment which allows you to settle your order by bank card like CB, VISA, MASTERCARD, AMERICAN EXPRESS, carte privative (AURORE, 4 ETOILES) or simply with your PayPal account.

After having booked your order, you will have to indicate that you will settle the totality of your order by PayPal.

You will be directly managed on the site of on-line payment PayPal (secure server).

You will then be invited to follow the process of on-line authentification and validation of payment of PayPal.

Further to your validation of payment, you will receive by e-mail an accused reception of the payment which will give evidence that your order was well recorded and is under treatment.

6 – DELIVERY PRICES

For deliveries outside the European Union, the prices appearing on bills are exclusive of VAT. Shipping costs are charged as a separate item and will depend on the weight of the ordered items, the country of destination and the method of transport chosen by the customer.

The delivery prices include the packaging, the handling and the shipping costs.

The cost will be determined at the time of the validation of your order.

We recommend you to group together your purchases in a unique order. We cannot group two different orders and you will have to settle shipping costs for each of them.

For the International (other countries than France) and French Overseas Department or territory: we study individually the cost according to the price list and to the regulations in force in the country addressee.

7 - DELIVERY

All our products are carefully packed. Parcel are oversized and protected, with in particular a care brought to the parcel containing fragile products.

Products in stock will be sent under 3 in 5 working days as from the effective payment. If the product is not any more in stock and proposed in command, it will be necessary to count an extension from 5 to 6 additional weeks. (Note: according to products LaCeremonieDesPetits reserve the right to propose it in command)

The Customer makes a commitment to indicate us an address to which the delivery can be made and which must be accessible by the deliverers of The Post office or the other carrier.

All orders are sent in Metropolitan France, in French Overseas Department or territory or on the international stage, either in "Colissimo", or in Chronopost in the choice of the customer.

The Post office will deliver your parcel within 48 hours for Metropolitan France (manufactured hours). On the other hand, The Post office does not make a commitment over a minimum deadline of delivery in the case of a delivery except Metropolitan France (indicative deadline from 4 to 8 working days for a delivery towards the international).

The delivery deadlines of our carriers are indicatives. LaCeremonieDesPetits cannot be considered in charge of the non compliance with indicated deadlines.

In the case of one order containing several articles among which some would not be in stock, the longest delivery deadline which will have been indicated on our site must be taken into account for the totality of the order (there will be no several sendings in the measure or postal charges are calculated for a group order). If you wish to be beforehand delivered products in stock before those who requires the most important deadline, we invite you to cross and to settle some order for which the expenses of delivery will be adjusted and settled in the various orders.

Note : When you receive a parcel you have to verify its aspect and open it in front of the deliverer or the mailman to avoid any future contesting. You have to make sure of the absence of abnormality (average, product missing with regard to the delivery, the damaged parcel, the hoarse object). We recommend you to use the delivery note of the carrier to indicate the damage noticed in the form of " handwritten detailed, dated, explicit reserves " and accompanied with your signature. If you choose to refuse the goods to the delivery, besides the " handwritten reserves ", you have to ask to the carrier for the dismissal of the parcel to the sender accompanied with a " report of despoliation ".

It can also be necessary to remind the facts under 3 working days following the delivery, by mails registered mails sent to LaCeremonieDesPetits and to the deliverer, especially if you did not make reserve for the delivery or if the parcel was put down in your mailbox without acknowledgement of receipt.

As from the delivery, the responsibilities of the delivered goods are transferred to the carrier then to the customer.

8 – RETURNS POLICY

According to the article L.121-20 of the French code of consumption, the customer can return (to his expenses) any article of his command within 7 true days as from the delivery date of his order. This return concerns article which would not be convenient for the customer.

The customer can choose between the exchange or the refund without penalty with the exception of the expenses of return of the product.

Attention ! Only products new, not carried, not transformed, not damaged and turned exclusively to their original packing in perfect state, will be taken back.

Do not send a returned product without having obtained beforehand a number of return by contacting us. If, by chance, you did not manage to contact us either in case of not reception of our answer, you have the possibility of meaning us your will to return the product by registered letter.

After check, if the product seems damaged, transformed or to have been carried, LaCeremonieDesPetits will be entitled to refuse purely and simply the return of the product and will preserve the payment.

In case of demand of refund, the refund will be made within 30 days as from the reception of the return of the product.

In case of abnormal or excessive returns, LaCeremonieDesPetits reserves the right to refuse a later order.

9 - RESPONSABILITIES

LaCeremonieDesPetits is responsible for the good execution of the order.

However, LaCeremonieDesPetits would not be considered in charge of the non-fulfillment of the contract because of the fact of the customer (not payment or partial payment), of a case of absolute necessity, strikes or total or partial disturbances of the activity of her suppliers, postal services or the other carriers, flood and set on fire.

The choice and the purchase of an article are placed under the only responsibility of the Customer. The total or partial impossibility to use articles in particular because of incompatibility with the needs of the Customer can give rise to neither compensation, nor refund, nor questioning of the responsibility of LaCeremonieDesPetits.

LaCeremonieDesPetits would not be considered in charge of the accidents which would result from a misuse of products by the customer.

To facilitate el treatment of a possible complaint, it is preferable that you ask within 3 months.

In case of disputes, above all, an amicable solution will have to be inevitably looked befor judicial appeal. If no amicable deal appears only the French Commercial court will be competent.

10 – TERMS OF THE FRENCH LAW "Informatiques et libertes" (computing and liberties)

LaCeremonieDesPetits.com has computing means intended to manage more easily the personal information of its customers (Customer databases).

Customer databases are reserved for the only use of the Web site LaCeremonieDesPetits.com.

It can be communicated only to the following addressee : LaCeremonieDesPetits - 3 Route du Petit Fossard- 77940 Esmans – France.

According to the articles 39 of the French law n° 78-17, of January 6th 1978, modified in 2004, about computing and liberties, people can obtain communication and, if necessary, rectification or deletion of the information concerning himself, by mail to LaCeremonieDesPetits.
